Terms of service.

This page is a plain-English summary of the contract between you and Something Cool Enterprise Limited. It is not legal advice. Where this summary conflicts with the contract you accept at checkout, the contract you accept at checkout governs.

1. Acceptance of terms

By accessing this site, creating an account, placing an order, requesting a quote, or engaging our services, you agree to be bound by these Terms. If you do not agree, do not use the site or our services. We may update these Terms; the "Last updated" date at the top reflects the current version, and continued use after that date constitutes acceptance.

2. About us and what we do

Something Cool Enterprise Limited is a Jamaican-registered company operating from Old Harbour, St Catherine. Our services include:

  • Air conditioning supply, installation, repair, and maintenance
  • Solar supply, installation, and maintenance
  • Sale of Mutabank-branded products and related accessories
  • Site assessments, consultations, and energy advisory

Service availability varies by parish and is subject to scheduling and technician availability. We may decline orders or service requests at our discretion (for example, where a site is unsafe or a request is outside our service area).

3. Accounts

Some features require an account. You are responsible for keeping your credentials confidential and for activity on your account. Provide accurate information and keep it current. We may suspend or close an account that violates these Terms.

4. Pricing and payment

  • Prices are in Jamaican Dollars (JMD) and include General Consumption Tax (GCT) at the prevailing rate
  • Product prices shown on the site are the firm price for the item as displayed
  • Delivery and installation pricing is set per quote — see Section 5 below
  • We accept Visa and Mastercard credit and debit cards via our hosted payment gateway. Bank transfer may be available for invoiced quote orders by arrangement.

5. Contract formation

A contract between us forms at different points depending on how you check out:

  • Pickup, pay-now orders — the contract forms when we receive a successful payment authorisation from our card gateway. Until that moment, your order is an offer that we may accept or decline.
  • Quote orders (any order involving delivery or installation) — submitting the order is your request for a quote. Nothing is charged. We review the order and send you a firm written quote. A contract forms when you pay the issued quote in full via our card gateway. Until then, either of us may walk away with no charge.

6. Quote validity and pricing methodology

  • Quotes are valid for 7 days from the date of issue unless we state otherwise on the quote
  • Once we have issued a quote and you have accepted it by paying, the price is firm. We do not use "subject to change" language; the price you accept is the price you pay.
  • Expired quotes are not binding on either side. You may request a re-quote at any time and we will assess again on current information.
  • Re-quotes may differ from the original quote because input costs, scope, or site conditions may have changed.

7. Customer obligations at installation

When we install at your site, you agree to provide, at no cost to us:

  • Safe, lawful access to the property and to the install location
  • Adequate and code-compliant electrical supply within reach of the install location
  • A structurally suitable mounting surface (wall, ceiling, slab, or roof) free of hidden services that would prevent safe fixing
  • Working WiFi at the install location for smart units that require it
  • A responsible adult on site for the duration of the install

If site conditions on arrival are not as described, we may suspend the install and reschedule. A return-trip fee may apply. We will tell you what needs to change before the next visit.

8. Pre-payment cancellation

You may cancel a quote order, free of charge, at any time before you pay. Use the cancel action on your order in your account, or email us. Cancellation after payment is governed by our refunds policy.

9. Bookings and rescheduling

  • Bookings are confirmed by email or WhatsApp and subject to availability
  • Rescheduling 24+ hours before the appointment is free; less than 24 hours may attract a fee per the refunds policy
  • We may reschedule due to weather, supply delays, technician illness, or other events beyond our reasonable control, and will offer the earliest practicable replacement window
  • No-shows without notice may forfeit a non-refundable deposit and affect future booking priority

10. Acceptable use

  • Do not use the site for unlawful purposes, to misrepresent your identity, or to interfere with our systems
  • Do not scrape, mirror, or reverse-engineer the site, or use it to train an automated model, without our written consent
  • Consumer-licensed goods you buy from us are for end use. Resale, re-export, or bulk redistribution requires a commercial account agreement
  • Do not impersonate Something Cool Enterprise, its staff, or its installers

11. Warranty

  • Installation workmanship — Something Cool Enterprise warrants our installation workmanship for 12 months from the date of completion
  • Mutabank-branded items — carry the Mutabank manufacturer warranty as supplied with the product. We pass that warranty through to you and will help you register and claim it.
  • Other equipment and parts— covered by the manufacturer's warranty as stated at the time of purchase
  • Repair services — parts and labour warranted for 90 days from the date of repair

Warranties do not cover damage caused by misuse, unauthorised modification, power surges, lightning, flood, fire, hurricane, or failure to follow recommended maintenance. Submit warranty claims by email or through your account.

12. Returns and refunds

13. Limitation of liability

To the fullest extent permitted by Jamaican law:

  • Our total aggregate liability arising out of or related to your use of the site or our services is capped at the total amount you paid us in the 12 months preceding the event giving rise to the claim
  • We are not liable for indirect, consequential, incidental, special, or punitive damages, or for lost profits, lost data, or loss of business
  • Nothing in these Terms limits our liability for gross negligence, fraud, death, or personal injury caused by our negligence, or any other liability that cannot be limited by law

14. Indemnity

You agree to indemnify Something Cool Enterprise, its officers, employees, and contractors against claims, damages, losses, and reasonable legal fees arising from your breach of these Terms, your misuse of our products or services, or your infringement of any third-party right.

15. Intellectual property

All content on this site, including text, graphics, logos, images, video, and code, belongs to Something Cool Enterprise or its licensors and is protected by Jamaican and international intellectual-property law. Do not reproduce, distribute, modify, or build derivative works from any content without our written consent. The Mutabank wordmark, badges, and product trade dress are protected and may only be used as supplied.

16. Privacy

We handle personal data in line with the Jamaica Data Protection Act 2020. Read our privacy policy for collection, use, retention, processors, transfers, and your data-subject rights.

17. Force majeure

We are not liable for delay or failure to perform caused by events outside our reasonable control, including hurricanes, flooding, lightning, earthquakes, fires, labour disputes, supply-chain disruptions, government action, utility outages, and public-health emergencies.

18. Governing law and jurisdiction

These Terms are governed by the laws of Jamaica. The courts of Jamaica have exclusive jurisdiction over any dispute arising out of or related to these Terms or your use of our services. We will attempt to resolve disputes by good-faith discussion before either of us starts formal proceedings, and your statutory consumer rights under the Consumer Protection Act are unaffected.
